1. Acceptance of Terms

By accessing or using the Guest2Host platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must stop using the Service immediately.

2. Description of Service (The "SaaS" Model)

Guest2Host provides software tools that allow property owners ("Hosts") to create their own direct booking websites and accept reservations from travelers ("Guests").

Important: Guest2Host is strictly a Software Provider. We are not:

• A party to any rental agreement between Hosts and Guests.
• A real estate broker, travel agency, or insurer.
• Responsible for the condition, safety, or legality of any property listed.

3. Account Registration & Security

• Eligibility: You must be at least 18 years old to use the Service.
• Account Security: You are responsible for maintaining the confidentiality of your login credentials. You accept responsibility for all activities that occur under your account.
• Accuracy: You agree to provide accurate, current, and complete information during registration.

4. User Content & "Import" Features

• Your Responsibility: You are solely responsible for all content (photos, text, reviews, pricing) that you upload, post, or import into Guest2Host ("User Content").
• Representations & Warranties: By importing content from third-party platforms (e.g., Airbnb, VRBO), you represent and warrant that you own or have the necessary rights to use that content on your own website.
• License to Us: You grant Guest2Host a non-exclusive, worldwide, royalty-free license to host, display, and reproduce your User Content solely for the purpose of providing the Service to you.
• Prohibited Content: You may not post content that is illegal, offensive, false, or infringes on the intellectual property rights of others.

5. Fees and Payments

• Subscription Fees: Hosts agree to pay the fees associated with their selected plan (e.g., Monthly Subscription or One-Time Lifetime Deal). All fees are non-refundable unless explicitly stated otherwise.
• Transaction Fees: Guest2Host does not charge a commission on bookings. However, payment processing fees are charged directly by Stripe (our payment processor) and are deducted automatically from the transaction.
• Taxes: Hosts are solely responsible for calculating, collecting, and remitting any applicable taxes (Occupancy Tax, VAT, etc.) related to their bookings. Guest2Host does not collect taxes on your behalf.

6. Bookings and Cancellations

• Contract between Host and Guest: Any booking made through a Guest2Host-powered website creates a direct contract between the Host and the Guest. Guest2Host is not a party to this contract.
• Cancellations: Cancellation policies are set exclusively by the Host. Guests must review the specific policy chosen by the Host before booking.
• Refunds: All refund disputes are between the Host and the Guest. Guest2Host has no authority to issue refunds or reverse transactions.

7. Third-Party Services

Our Service integrates with Stripe for payment processing. By using Guest2Host, you also agree to the Stripe Connected Account Agreement. Guest2Host is not liable for any errors or delays caused by Stripe.

8. Limitation of Liability

• "As Is" Service: The Service is provided "as is" and "as available" without warranties of any kind.
• No Liability for Damages: Guest2Host shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
• Cap on Liability: In no event shall Guest2Host's total liability to you exceed the amount you have paid to Guest2Host in the last twelve (12) months.

9. Indemnification

You agree to defend, indemnify, and hold harmless Guest2Host and its officers, directors, and employees from any claims, damages, liabilities, and expenses (including legal fees) arising out of:

• Your use of the Service.
• Your violation of these Terms.
• Your violation of any third-party right (including intellectual property or privacy rights).
• Any dispute between a Host and a Guest.

10. Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to modify these terms at any time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
